Military Courts for Palestinians:
Israeli military courts have been trying Palestinians in the Territories since the occupation began. While the courts offer an illusion of proper judicial conduct, they mask one of the most injurious apparatuses of the occupation. In these courts, the judges and prosecutors are always Israeli soldiers in uniform. The Palestinians are always either suspects or defendants, and are almost always convicted for violating orders issued by the occupation regime. As such, these courts simply cannot be an impartial, neutral arbitrator. They are firmly entrenched on the Israeli side of the power imbalance, and serve as one of the central systems maintaining its control over the Palestinian people.

Administrative Detention
Administrative detention is incarceration without trial or charge, alleging that a person plans to commit a future offense. It has no time limit, and the evidence on which it is based is not disclosed. Israel employs this measure extensively and routinely, and has used it to hold thousands of Palestinians for lengthy periods of time. While detention orders are formally reviewed, this is merely a semblance of judicial oversight, as detainees cannot reasonably mount a defense against undisclosed allegations. Nevertheless, courts uphold the vast majority of orders.

Terrorism of Settler Colonial State

Open-Fire Policy
Israel has killed thousands of Palestinians in the Occupied Territories over the years, ostensibly acting in accordance with the limitations the military’s open-fire regulations and international humanitarian law impose on the use of gunfire. But this is no more than a semblance of legality. Gunfire is also used in many other cases, with backing from the government, the courts and the military. This policy reflects deep disregard for Palestinian lives and property and enables the continued use of lethal force, crucial to enabling Israel to retain its violent control over millions of Palestinians.

No Accountability
Accountability for human rights violations is crucial to justice and the rule of law. Israel shirks this responsibility when it comes to its actions in the Occupied Territories, instead putting in place systems which do no more than offer the semblance of law enforcement, in both criminal and civil law. Those responsible go unpunished and victims are denied compensation, apart from rare exceptions that merely serve to reinforce the illusion of a functioning law enforcement system. Not only does the lack of deterrence and oversight enable human rights abuse, it also facilitates the continuation of the occupation itself.
